What is a Child Custody Investigation?

When parents decide to divorce or legally separate, a decision must be reached regarding the custody of their children. Often times, this can be the most difficult part of the process. When parents cannot reach an agreement regarding child custody, a judge may order a custody evaluation.

When determining child custody, judges prioritize the well-being of the child above the desires of the parents. If a parent is believed to be unfit for the responsibility of providing a safe and secure environment for the child, this must be backed up by clear and objective evidence.

Types of Custody

A judge may grant sole custody to one parent or divide legal and/or physical custody between the parents. 

Physical Custody

Physical custody is the right to have the child live with a parent. Physical custody can be granted to one parent, or split jointly.

When parents have joint physical custody, one parent is usually granted primary physical custody, meaning the child lives with that parent majority of the time. 

Legal Custody

Legal custody refers to the right to make long-term decisions regarding the child. Legal custody can be granted to one parent, or split jointly.

Judges often award joint legal custody, which means both parents have a say in major life decisions for the child. However, one parent will be granted final decision-making power.

Sole Custody

A parent who has sole custody has physical and legal custody of the child. The other parent is not allowed to make decisions that affect the child, but may be granted visitation.
